Privacy Notice

Version 1.0 · Last updated September 24, 2026

This is an earlier version kept for your records. The current version is at /legal/privacy.

1. Who we are

This Privacy Notice explains how FreshWave Insurance Agency LLC (“FreshWave,” “we,” “us”) collects, uses, shares, and protects personal information through this website, our client portal, and our work as your insurance agency.

FreshWave is an insurance agency owned by Charlotte Anumudem, a licensed insurance producer. We are not an insurance company. The insurance companies (“carriers”) that issue policies make underwriting, coverage, claim, and payment decisions. When you buy a policy, the carrier’s own privacy notice also applies to the information the carrier holds.

2. Effective date and updates

Version 1.0 of this notice is effective September 24, 2026, and was last updated on September 24, 2026. Earlier versions, when they exist, are listed at the end of this page.

3. Where we serve

We serve individuals, families, and businesses in Minnesota and North Dakota. Sections 23 and 24 describe rights that apply specifically to Minnesota and North Dakota residents.

4. Information we collect

Depending on how you work with us, we collect:

  • Contact and identity information: your name, email address, telephone number, residence and mailing address, state, preferred contact method, and the best time to reach you.
  • Quote and coverage information: the type of insurance you are interested in, your current insurance, and details you choose to provide about vehicles (year, make, model, and use, but not vehicle identification numbers), drivers in your household (names, dates of birth, license state, and driving history such as accidents or violations), homes and rentals, businesses, and the kind of life insurance you want to discuss.
  • Account information: your email address and a password when you create a client account. Your password is handled by our authentication provider and stored only in hashed form; nobody at FreshWave can see it.
  • Policy information: the carrier, product, a masked policy number, and effective and expiration dates of policies placed through us.
  • Accident and incident reports: what happened, when and where (as you describe it), the vehicles and people involved, whether injuries were reported and a short description if you choose to give one, police and towing information, witness names and contact details you provide, and accident photographs you upload.
  • Roadside requests: the type of help you need, a location description you type yourself, a description of the vehicle, and whether you agreed to share that location with us.
  • Complaints and messages: the category and description of your concern and messages you send us.
  • Choices and records: the privacy notice version you acknowledged, consents you give or withdraw (for example, for text messages or a repair-shop referral), and the history of your requests.
  • Technical information needed to run the site: sign-in session cookies and security logs. See section 14.

We do not collect Social Security numbers. Our website forms do not ask for driver’s-license numbers, vehicle identification numbers, bank or payment-card numbers, or medical records, and they reject those identifiers if sent. If a carrier later requires a driver’s-license number for an application, we will collect it only through an approved, secure insurance workflow and will tell you first.

5. Where the information comes from

  • From you, through our forms, the client portal, email, telephone, and mail.
  • From people you authorize to act for you, such as a household member you list on a quote request.
  • From insurance companies we work with about policies and claims you have with them.
  • From our own records of your transactions and communications with us.

We do not currently buy information about you from data brokers or obtain consumer reports ourselves. Carriers may obtain consumer reports, motor-vehicle records, or claims-history reports when you apply for coverage; the carrier’s notice explains those practices.

6. Why we collect it

  • To respond to your quote, consultation, or contact request.
  • To help you apply for, buy, change, and keep insurance.
  • To help you report an accident or loss and follow up with the carrier.
  • To handle roadside-assistance requests and complaints.
  • To keep your account secure and to prevent fraud and misuse.
  • To meet our legal, regulatory, record-keeping, and licensing obligations in Minnesota and North Dakota.

7. How we use it

We use personal information only for the purposes in section 6 and closely related purposes, such as keeping accurate records, training our staff, and improving our service. Access inside FreshWave is limited by role: for example, marketing staff cannot see claims, complaints, roadside details, photographs, or other client records. We do not use your information for automated decisions about you.

8. When and why we share information

We do not sell your personal information, and we do not receive payment for referrals. We share information only as described here:

  • With insurance companies, with your authorization, to obtain quotes, submit applications, service your policy, or report a claim you ask us to report. The quote form asks for this authorization before you submit.
  • With service providers that run our systems for us under contract, such as our database, authentication, file-storage, and website-hosting providers. They may use the information only to provide services to us.
  • With a repair shop, only for a repair-related purpose and only after you give specific written consent that names the shop and the information to be shared. See section 9.
  • With regulators, law enforcement, courts, and others when the law requires or permits it, including to respond to a subpoena or court order, to cooperate with a state insurance department, or to detect and prevent fraud, misrepresentation, or criminal activity connected with insurance.
  • With our attorneys, accountants, and auditors, and with a buyer or successor if our business is sold or transferred, subject to confidentiality.
  • With anyone else at your direction or with your consent.

9. Carriers, service providers, repair partners, and legal disclosures

Insurance companies: we share the information you give us for a quote, application, policy change, or claim with the carrier or carriers involved, and only with your authorization.

Service providers: our systems are operated with third-party technology providers. They process information on our behalf and are not permitted to use it for their own purposes.

Repair partners: if you ask us to connect you with a repair shop, such as a community partner listed on our website, we share only the minimum contact details you approve (your name, telephone number, email address, or preferred contact method). We never share accident details, policy or claim information, license numbers, photographs, documents, medical information, or location information with a repair shop. Your consent is specific to the named shop, is recorded with the date and the staff member who acted on it, and you may withdraw it at any time. Choosing or not choosing a particular repair shop does not affect your coverage or claim payment; you may choose any repair facility, subject to your policy and applicable law. Repair-partner referrals are not yet active and currently operate only in a recorded test mode.

Legal, fraud-prevention, and regulatory disclosures: we disclose information when required or permitted by law, as described in section 8.

We ask for your consent before we: share your information with an insurance company for a quote or application; share contact details with a repair shop; send you text messages; or use a location description you give us for a roadside request. You may decline, and you may withdraw a consent you gave from the Consent History page of the client portal or by contacting us. Withdrawing consent does not undo sharing that already happened with your consent, and some services may not be available without it.

11. Your choices and opt-out rights

  • Marketing email: we do not send marketing email. We will not start until we have a compliant sign-up, unsubscribe, and consent-recording process, and then only to people who opt in.
  • Text messages: we send text messages only after you give consent, and you can withdraw it at any time. Text messaging is not currently turned on.
  • Sharing with third parties: other than the sharing described in section 8, we do not share your information with outside companies for their own marketing.
  • Contact preferences: you can update your preferred contact method in the client portal or by calling us.

12. Access, correction, and deletion

You may ask to see the personal information we hold about you, to correct information you believe is wrong, and to delete information we no longer need. Send your request to contact@freshwaveinsurance.com or call us. We will verify your identity before acting on a request.

Some limits apply. We may not be able to delete information that the law, a carrier agreement, a claim, a complaint, a tax requirement, or a legal hold requires us to keep, and access rights may not extend to information collected in connection with a claim or legal proceeding (“privileged information”). If we decline a correction, you may send a short statement explaining why you disagree, and we will keep it with your record. Sections 23 and 24 describe state-specific rights.

13. How long we keep information

We keep personal information for as long as needed for the purposes in this notice and as required by law. We are reviewing a general retention period of four years after the end of a client relationship, but we have not turned on automatic deletion. Some records must be kept longer under Minnesota or North Dakota law, carrier agreements, tax rules, complaint and claim rules, or a legal hold. When information is no longer needed, we delete or anonymize it through a documented, reviewed process.

14. Cookies and analytics

We use only cookies that are strictly necessary: sign-in session cookies that keep you signed in to the client portal. We do not use Google Analytics, advertising pixels, social-media tracking pixels, or other analytics or behavioral-tracking tools, and we do not allow third parties to track you on our site.

Our website can work offline for a few basic pages. Your browser stores a copy of the offline page and site icon for this purpose; it does not store your form answers, portal pages, or personal information. Quote-form answers are kept only on the open page until you submit them.

15. Accounts and sign-in

Client and staff accounts are protected by passwords that must be at least 12 characters. Password-recovery links are single-use and expire after a short time, and after a password change we sign out your other sessions. Signed-in sessions expire and require you to sign in again. Our staff can send you an account invitation or a password-reset link, but they cannot see or set your password.

16. Documents and photographs

You may upload photographs of an accident or loss with an incident report. Photographs are stored in private storage that only you and authorized FreshWave staff can open, and they are checked for file type and size when uploaded. We do not accept other insurance documents through the website at this time.

17. Location information and roadside requests

We do not collect your device’s precise location. For a roadside request, you type a description of where you are, and we ask whether you agree to share it with us for that request. In an emergency, call 911. FreshWave is not an emergency or dispatch service and does not send roadside providers; we help you contact your insurance carrier’s roadside service.

18. Accident, complaint, claim, quote, and policy information

Information in accident reports, complaints, claim records, quote requests, and policy records is used to handle that request and is visible only to you and to FreshWave staff whose role requires it. Submitting an accident report to FreshWave does not by itself report the claim to your insurance company; we help you do that, and a carrier claim number is recorded only after the carrier provides one. We keep a history of status changes and a security log of who accessed or changed records, without copying the details into the log.

19. Email, telephone, and text communications

We contact you by telephone or email about your requests, policies, and account. We send notices about your requests through the client portal, and those notices never include the details of your request. Text messages are used only with your consent (see section 11). Please do not send Social Security numbers, license numbers, payment details, or medical information by email.

20. How we protect information

We use administrative, technical, and physical safeguards appropriate to our size and the sensitivity of the information, including role-based access limits, private storage for photographs, encrypted connections for our website, security logging, rate limits on sign-in and forms, and screening of the service providers we use. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a security incident affects your personal information, we will notify you and the appropriate regulators as the law requires.

21. Children’s privacy

Our website is not directed to children under 13, and we do not knowingly collect personal information from them. A parent or guardian may give us information about a minor in their household, such as a teen driver on an auto quote. If you believe a child has sent us information, contact us and we will delete it unless the law requires us to keep it.

Our site links to other websites, such as state insurance regulators, insurance companies, and map services for directions to a community partner. Those sites have their own privacy practices. A map link sends only the partner’s address to the map service when you choose to open it.

23. Minnesota residents

Minnesota’s Insurance Fair Information Reporting Act (Minnesota Statutes, sections 72A.49 to 72A.505) gives you rights about personal information collected in connection with an insurance transaction. You may request, in writing and with proper identification, access to recorded personal information about you, and you may request that we correct, amend, or delete it. We will respond within 30 business days. If we decline a correction, you may file a statement of disagreement, which we will keep with your record and include in later disclosures, and you may ask the Minnesota Commissioner of Commerce to review the matter. We do not disclose your personal information without your written authorization except as that law permits, for example to detect or prevent fraud, to insurance regulators, or as required by law.

24. North Dakota residents

North Dakota’s privacy rules for insurance licensees (North Dakota Administrative Code chapter 45-14-01) require your authorization before we disclose nonpublic personal financial information to an unaffiliated third party, except as those rules allow, such as disclosures needed to process an insurance transaction you request, to prevent fraud, or to comply with law. We do not disclose nonpublic personal health information, such as injury information in an accident report, without your authorization except for insurance functions those rules permit, such as claims administration. You may give or refuse authorization, and you may revoke it at any time by telling us in writing, including by email to contact@freshwaveinsurance.com.

25. Privacy questions and requests

Email: contact@freshwaveinsurance.com. Telephone: 701-566-3656 (Monday to Friday, 9:00 AM to 5:00 PM, and Saturday, 9:00 AM to 12:00 PM, Central Time). You may also contact the Minnesota Department of Commerce or the North Dakota Insurance Department with a concern at any time.

26. Changes to this notice

When we change this notice, we post the new version here with a new version number and date and keep earlier versions available below. If a change is material, for example a new kind of sharing, we will tell signed-in clients in the client portal and ask them to review and acknowledge the new version, and we will ask for any new authorization the law requires before sharing information in a new way.
